    Types of data collected

    The Controller does not provide a list of the types of personal data collected.

    Detailed information about each type of data collected can be found in the relevant sections of this Privacy Policy or in specific informational texts displayed before such data is collected.
     Personal data may be provided voluntarily by the user or, in the case of user data, may be collected automatically during the use of DeFlorance.
     Unless otherwise specified, all data requested by DeFlorance is mandatory. If the user refuses to provide it, it may be impossible for DeFlorance to provide the service. In cases where DeFlorance designates certain data as optional, the User is free not to provide such data without affecting the availability of the Service or its operation.
     Users who are not sure which data are mandatory are requested to contact the data controller.
     The possible use of cookies - or other tracking tools - by DeFlorance or by the owners of the third party services used by DeFlorance, unless otherwise specified, is for the purpose of providing the service requested by the user, in addition to the other purposes described in this document and in the Cookie Policy, if any.

    The User assumes responsibility for the personal data of third parties received, published or shared through DeFlorance and guarantees that he/she has the right to transmit or disseminate them, releasing the Owner from any liability towards third parties.

    Method and place of data processing

    Treatment methods

    The controller shall take appropriate security measures to prevent unauthorized access, disclosure, alteration or destruction of personal data.
     The processing is carried out with the help of informatics and/or telematics instruments, and the organizational and logical procedures are strictly related to the indicated purposes. In addition to the data controller, in some cases other persons involved in the organization of DeFlorance (administration, sales, marketing, legal department, system administrators) or external persons (e.g. third party technical service providers, mail couriers, hosting providers, IT companies, communication agencies), who may have been designated by the data controller as data processors, may have access to the data. The updated list of data processors may be requested from the Controller at any time.

    Legal basis for processing

    The controller processes personal data of the user when one of the following conditions is met:

    • the user has given consent for one or more specific purposes; Note: In some jurisdictions, the controller may be permitted to process personal data without the user's consent or one of the other legal bases mentioned below until the user objects to such processing ("opts-out"). However, this does not apply if the processing of personal data is regulated by European legislation on the protection of personal data;
    • the processing is necessary for the performance of a contract with the user and/or the performance of pre-contractual measures;
    • processing is necessary for compliance with a legal obligation to which the controller is subject;
    • processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
    • the processing is necessary for the pursuit of the legitimate interest of the controller or a third party.

    However, there is always the possibility to ask the controller to explain the specific legal basis of each processing operation and, in particular, to indicate whether the processing is based on a lawful basis, is required by a contract or is necessary for the conclusion of a contract.

    Location

    The data will be processed at the controller's premises and at any other place where the parties involved in the processing are located. For more information, please contact the data controller.
     The User's personal data may be transferred to a country other than the country in which the User is located. For more information about the location of the processing, the User may refer to the section on the details of the processing of personal data.

    The User has the right to obtain information about the legal basis for the transfer of data outside the European Union or to an international organization governed by international law or consisting of two or more countries, such as the UN, and about the security measures taken by the Controller to protect the data.

     The user can verify whether any of the transfers just described take place by reading the section of this document dealing with the details of the processing of personal data, or can request information from the controller by contacting him using the contact details provided at the beginning of this document.

    Conservation period

    The data will be processed and stored for as long as required by the purposes for which they were collected.

    Therefore:

    • Personal data collected in connection with the performance of a contract between the controller and the user will be stored until the performance of this contract.
    • Personal data collected for purposes related to the legitimate interest of the controller will be kept until such interest is fulfilled. The User may obtain further information about the legitimate interest pursued by the Controller in the relevant sections of this document or by contacting the Controller.

    If the processing is based on the consent of the user, the controller may keep the personal data longer until the consent is revoked. In addition, the controller may be obliged to retain personal data for a longer period due to a legal obligation or an official order.

     After expiration of the retention period, the personal data will be deleted. Therefore, after the expiry of this period, the right of access, deletion, rectification and the right to data portability can no longer be exercised.



    User rights

    Users may exercise certain rights in relation to the data processed by the controller.

    In particular, the user has the right to:

    • revoke the consent at any time. The user may revoke his previously declared consent to the processing of his personal data.
    • object to the processing of their data. You can object to the processing of your data if it is based on a legal basis other than consent. You can find more details on the right to object in the section below.
    • Access to their data. The user has the right to obtain information about the data processed by the controller and about certain aspects of the processing, and to obtain a copy of the data processed.
    • verify the accuracy of the data and request its correction. The user may verify the accuracy of his data and request its update or correction.
    • to obtain the restriction of processing. If certain conditions are met, the user may request the restriction of the processing of his data. In this case, the controller will not process the data for any purpose other than their storage.
    • obtain the deletion or removal of their personal data. If certain conditions are met, the user may request the deletion of their data by the data controller.
    • to receive their data or to transmit them to another data controller. The user has the right to receive their data in a structured, common and machine-readable format and to have it transferred to another data controller without hindrance, as far as technically possible. This provision applies if the data is processed by automated means and the processing is based on the consent of the user, on a contract to which the user is a party, or on contractual measures in connection therewith.
    • Filing a complaint. The user may file a complaint with the competent data protection supervisory authority or take legal action.

    Details of the right to object

    Where personal data are processed in the public interest, in the exercise of official authority vested in the controller or in pursuit of a legitimate interest of the controller, users have the right to object to the processing on grounds relating to their particular situation.

    Users are informed that in case their data is processed for direct marketing purposes, they may object to the processing without giving any reason. To find out whether the controller processes data for direct marketing purposes, users may consult the relevant sections of this document.

    How to exercise rights

    In order to exercise their rights, users may send a request to the contact details of the controller indicated in this document. The requests will be made free of charge and will be processed by the controller as soon as possible, and in any case within one month.

    More information about the treatment

    Defense in court

    The User's personal data may be used by the Data Controller in legal proceedings or in the preparation phase of such proceedings in order to defend against abuses in the User's use of DeFlorance or related services.
     The User declares that he/she is aware that the Owner may be obliged to disclose the data upon the order of public authorities.

    Specific information

    At the User's request, DeFlorance may provide the User with additional and contextual information about specific services or the collection and processing of personal data, in addition to the information contained in this Privacy Policy.

    System logs and maintenance

    For operational and maintenance purposes, DeFlorance and the third party services it uses may collect system logs, which are files that record interactions and which may include personally identifiable information, such as the user's IP address.

    Information not included in this policy

    Further information in connection with the processing of personal data can be requested at any time from the controller using the contact details provided.

    Responding to Do Not Track requests

    DeFlorance does not support "Do Not Track" requests.
     To find out if the services used by third parties support it, the user is asked to consult their respective privacy policies.

    Changes to this Privacy Policy

    The Controller reserves the right to modify this Privacy Policy at any time by informing users on this page and, if possible, on DeFlorance and, if technically and legally possible, by sending a message to users through one of the contact details on file with the Controller. We therefore ask you to consult this page frequently, paying attention to the date of the last modification indicated below.

     If the changes concern a processing whose legal basis is consent, the controller will obtain the user's consent again, if necessary.
